Welcome to Inaiwazhi, a product by SoftClinch Consulting Services Pvt. Ltd. (“we,” “our,” “us”). By accessing or using our platform (the “Service”), you agree to these Terms and Conditions (“Terms”). Please read them carefully.

1. Use of the Platform

  • The Service allows users to create and manage automated WhatsApp, SMS, and Email campaigns using AI-powered tools.
  • You agree to use the Service only for lawful business communication purposes, in compliance with applicable laws and Meta’s WhatsApp Business Policies.
  • You are responsible for maintaining the confidentiality of your account credentials.

    • 2. Eligibility

  • You must be 18 years or older and authorized to act on behalf of your business to use this Service.
  • By registering, you represent that all information provided is accurate and complete.

    • 3. Account Registration and Access

  • You must create an account to use the Service.
  • You are responsible for all activities under your account.
  • We reserve the right to suspend or terminate accounts engaged in spam, abuse, or non-compliance.

    • 4. Payments and Billing

  • All plans are billed on a monthly or annual basis.
  • Payment is required in advance through accepted methods.
  • Invoices are generated automatically, and failure to pay may result in suspension of service.
  • All fees are exclusive of applicable taxes.

    • 5. Service Features

  • Access to features depends on your selected plan.
  • We may modify or upgrade features periodically to enhance user experience.

    • 6. User Responsibilities

    You agree to:

  • Send messages only to customers who have opted in.
  • Ensure message templates comply with WhatsApp Business Policy.
  • Refrain from using the platform for unlawful or misleading campaigns.
  • Maintain accurate contact and billing information.

    • 7. Intellectual Property

    All software, design, and content within the platform are owned by SoftClinch Consulting Services Pvt. Ltd. You may not copy, modify, or redistribute the platform or any part of its code without prior written consent.

    8. Data Protection and Privacy

    All data handling follows our Privacy Policy and Data Processing Addendum.

    We process personal data only for delivering and improving our services.

    9. Limitation of Liability

    We are not liable for:

  • Indirect or consequential damages.
  • Business loss resulting from third-party integrations or downtime.
  • Errors caused by user-provided data or misuse of the platform.

    • Total liability shall not exceed the amount paid in the preceding 3 months of subscription.

    10. Termination

    You may cancel your subscription at any time.

    We may terminate or suspend your account for violations of these Terms, illegal use, or non-payment.

    11. Governing Law

    These Terms are governed by the laws of India.

    Disputes shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu.
